These v1.6 Terms cover the free Golden Ticket and $8 lifetime cartridge upgrades. No monthly membership or recurring subscription is offered at this time.

1. Acceptance

By selecting an “I Agree,” “Accept & Download,” registration, purchase, or equivalent acceptance control, you agree to these Terms and the Privacy Policy. If you do not agree, do not use that control or the applicable software. A parent, guardian, teacher, or school representative accepting for a minor is responsible for supervising that minor's use.

2. Free cartridges and paid cartridges

Everything needed to start is free through the Golden Ticket. A paid cartridge or named pack is $8 one time for lifetime use when verified checkout is available. No monthly membership, recurring subscription, or free trial is offered.

3. Current launch

No membership is required to start. Free Founding Member recognition may be offered to qualifying verified accounts; it is recognition only; it does not create a subscription, change the free start, or grant unpurchased cartridges.

4. Personal perpetual software license

Subject to these Terms, a free download or completed purchase grants you a personal, non-exclusive, non-transferable, perpetual license to use the downloaded version of the applicable cartridge on the permitted device or devices. “Lifetime,” “keep forever,” and “ownership” describe your continuing right to use that downloaded copy without recurring fees. They do not transfer the software's intellectual-property ownership and do not guarantee perpetual hosting, Internet availability, technical support, compatibility with every future device, or creation of future versions.

5. Intellectual property

The cartridge system, software, original cartridge concepts, original written content, question banks, study guides, compilations, designs, branding, and related original materials are owned by Bret Fencl unless expressly stated otherwise. Fencl Web Design.Com, LLC, doing business as Enlightening All, operates and distributes the products. Public-domain and properly licensed third-party materials retain their respective legal status. Downloading or purchasing a cartridge does not grant permission to resell, republish, remove ownership notices, reverse engineer protected portions, or present the work as your own.

6. Referrals and rewards

No paid referral, commission, or Member Rewards program is active or promised at this time. A shared-link identifier may be recorded for security and aggregate attribution only. Any future program would require separate current published terms; older reward amounts, commission rules, and payout promises are retired.

7. Educational information—not professional advice

This software provides general educational and organizational information. It is not medical, nursing, emergency, legal, tax, accounting, investment, financial, engineering, electrical, food-safety, agricultural, or other professional advice.

Do not delay professional or emergency help because of something in a cartridge. In an emergency, contact 911 or the appropriate local emergency service. Financial and prediction content does not guarantee results. First-aid and survival material does not replace certified training. Science, food-growing, cooking, electrical, exercise, yoga, health, fertility, pregnancy, and recovery activities require appropriate adult supervision, equipment, environment, judgment, and qualified professional guidance.

8. Assumption of risk

You voluntarily choose whether and how to use the cartridges and accept the ordinary risks of the activities you undertake, including physical strain or injury, falls, burns, cuts, food contamination, allergic reactions, equipment or device damage, data loss, financial loss, and incorrect application of information. Inspect your surroundings and equipment, follow safety notices, keep backups when appropriate, obtain professional advice, and stop any activity that appears unsafe or causes pain, dizziness, breathing difficulty, or unusual symptoms.

9. No warranty

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE, CARTRIDGES AND CONTENT ARE PROVIDED “AS IS,” “AS AVAILABLE” AND “WITH ALL FAULTS,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, COMPATIBILITY, TITLE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION, CONTINUED HOSTING, FUTURE UPDATES, PARTICULAR RESULTS, OR COMPATIBILITY WITH FUTURE DEVICES OR OPERATING SYSTEMS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRET FENCL, FENCL WEB DESIGN.COM, LLC, ENLIGHTENING ALL, AND THEIR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES; LOST PROFITS; LOST DATA; LOSS OF USE; DEVICE OR PROPERTY DAMAGE; OR CLAIMS ARISING FROM RELIANCE ON OR INABILITY TO USE THE SOFTWARE. FOR A PAID CARTRIDGE, TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID FOR THE CARTRIDGE GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT APPLICABLE LAW DOES NOT PERMIT TO BE EXCLUDED OR LIMITED, INCLUDING LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR OTHER NONWAIVABLE CONDUCT.

11. Third-party services and links

Cartridges and pages may link to payment processors, music, video, social networks, source material, government resources, or other third parties. Those services are independent, may change, and have their own terms and privacy practices. A link is not a warranty or control of the third party.

12. Acceptable use

Do not use the service to violate law, harm another person, distribute malware, bypass a paid access control, impersonate another person, interfere with security, scrape private account data, exploit a minor, or infringe intellectual property. Reasonable personal backups of downloaded cartridge files are permitted unless a specific license says otherwise.

13. Environmental mission

Enlightening All is designed to reduce repeated network transfers, keep more information on the user's device, and extend the useful life of compatible devices. These are design goals, not guaranteed or quantified environmental results. Actual bandwidth, energy, carbon, and electronic-waste effects depend on device, network, electricity source, and usage.

14. Governing law and venue

These Terms and disputes concerning them are governed by the laws of the State of Florida, without regard to conflict-of-law principles. To the extent legally permitted, exclusive venue shall lie in the state courts located in Brevard County, Florida, or, when federal jurisdiction exists, the United States District Court for the Middle District of Florida, Orlando Division. This section does not waive any consumer right that applicable law does not permit the parties to waive.

15. Severability, changes, and entire agreement

If a provision is held unenforceable, it will be enforced to the greatest lawful extent and the remaining provisions will continue. We may update these Terms prospectively by posting a new effective date and version. Material changes affecting registered users may also be communicated through the website, account, or email. These Terms, the Privacy Policy, the applicable purchase terms, and any cartridge-specific safety notice form the agreement for use of the applicable product.
